Bernie Sanders (I-Vt.), current Chairman of the Senate Committee on Health, Education, Labor, and Pensions (HELP), today released the following statement on H-1B guest worker visas and recent debate concerning the program: There has been a lot of discussion lately about the H-1B guest worker program. Elon Musk and a number of other billionaire tech company owners have argued that this federal program is vital to our economy because of the scarcity of highly skilled American engineers and other tech workers. I disagree. The main function of the H-1B visa program and other guest worker initiatives is not to hire “the best and the brightest,” but rather to replace good-paying American jobs with low-wage indentured servants from abroad. The cheaper the labor they hire, the more money the billionaires make.In 2022 and 2023, the top 30 corporations using this program laid off at least 85,000 American workers while they hired over 34,000 new H-1B guest workers. There are estimates that as many as 33 percent of all new Information Technology jobs in America are being filled by guest workers. Further, according to Census Bureau data, there are millions of Americans with advanced degrees in science, technology, engineering, and math who are not currently employed in those professions.If there is really a shortage of skilled tech workers in America, why did Tesla lay-off over 7,500 American workers this year – including many software developers and engineers at its factory in Austin, Texas – while being approved to employ thousands of H-1B guest workers?Moreover, if these jobs are only going to “the best and brightest,” why has Tesla employed H-1B guest workers as associate accountants for as little as $58,000, associate mechanical engineers for as little as $70,000 a year, and associate material planners for as little as $80,000 a year? Those don’t sound like highly specialized jobs that are for the top 0.1 percent as Musk claimed this week.If this program is really supposed to be about importing workers with highly advanced degrees in science and technology, why are H-1B guest workers being employed as dog trainers, massage therapists, cooks, and English teachers? Can we really not find English teachers in America?Let’s be clear. To the extent that there may be labor shortages in our country in some highly specialized areas that need to be filled by employees from abroad through the H-1B program, we must utilize this program as a very short-term and temporary approach. In the long term, if the United States is going to be able to compete in a global economy, we must make sure that we have the best educated workforce in the world. And one way to help make that happen is to substantially increase the guest worker fees large corporations pay to fund scholarships, apprenticeships, and job training opportunities for American workers. This is something that I have advocated from my first days as a U.S. senator.Further, we must also significantly raise the minimum wage for guest workers, allow them to easily switch jobs, and make sure that corporations are required to aggressively recruit American workers first before they can hire workers from overseas. The widespread corporate abuse of the H-1B program must be ended.Bottom line. It should never be cheaper for a corporation to hire a guest worker from overseas than an American worker.Mr. Musk, Mr. Ramaswamy, and others have argued that we need a highly skilled and well-educated workforce. They are right. But the answer, however, is not to bring in cheap labor from abroad. The answer is to hire qualified American workers first and to make certain that we have an education system that produces the kind of workforce that our country needs for the jobs of the future. And that’s not just engineering. We are in desperate need of more doctors, nurses, dentists, teachers, electricians, plumbers, and a host of other professions.Thirty years ago, the economic elite and political establishment in both major parties told us not to worry about the loss of blue-collar manufacturing jobs that would come as a result of disastrous unfettered free trade agreements like NAFTA and Permanent Normal Trade Relations with China (PNTR). They promised that those lost jobs would be more than offset by the many good-paying, white-collar information technology jobs that would be created in the United States.Well, that turned out to be a Big Lie. Not only have corporations exported millions of blue-collar manufacturing jobs to China, Mexico, and other low-wage countries, they are now importing hundreds of thousands of low-paid guest workers from abroad to fill the white-collar technology jobs that are available.At a time of massive income and wealth inequality, when the richest three people in America now own more wealth than the bottom half of our country and when the CEOs of major corporations make almost 300 times more than their average workers, we need fundamental changes in our economic policies. We need an economy that works for all, not just the few. And one important way forward in that direction is to bring about major reforms in the H-1B program.

On Thursday, a three-judge panel for the U.S. Court of Appeals for the 6th Circuit ruled against the Federal Communications Commission's 2024 Net Neutrality rulemaking, which empowered the agency to protect internet users against all manner of abuse by major broadband internet access providers like AT&T, Comcast and Verizon. In April, the FCC reinstated its Title II authority over broadband-internet access. This authority empowers the agency to hold powerful telecommunications companies accountable for providing service on just, reasonable and nondiscriminatory terms to internet users throughout the United States. It also serves as the basis for the FCC’s Net Neutrality rules, which prohibit those companies from blocking, slowing down, or charging extra for the internet content and applications their broadband customers choose. In September, Free Press filed a brief in the case supporting the FCC's April ruling. The brief — filed jointly with the Benton Institute, the National Association of Regulatory Utility Commissioners, the Open Technology Institute and Public Knowledge — focused on the legal precedent and economic analysis supporting the Commission’s decision, showing the wisdom of and the need for the FCC’s jurisdiction over the essential telecommunications platform of our time.The 6th Circuit ruled nevertheless that broadband internet access service should be classified as a Title I “information service” under the Communications Act. The court rejected the Biden FCC’s argument that broadband should be classified as a “telecommunications service,” subject to the FCC’s mandates and authority in Title II of the Act to ensure service on an equitable and nondiscriminatory basis. Free Press Vice President of Policy and General Counsel Matt Wood said:“Beyond being a disappointing outcome, today’s 6th Circuit opinion is just plainly wrong at every level of analysis. The decision missed the point on everything from its granular textual analysis and understanding of the broader statutory context, to the court’s view of the legislative and agency history, all the way to its conception of Congress’s overarching policy concerns.“Unfortunately, this result also shows why the industry suing the FCC was so eager to engage in forum-shopping to get this case away from the federal court in Washington, D.C. — which had developed deep expertise on broadband issues during prior rounds of litigation. “In April, the FCC issued an order that properly restored the agency’s congressionally granted oversight authority to protect people from any ISP discrimination and manipulation. That common-sense FCC order tried to ensure that the companies providing America with the essential communications service of this century don’t get to operate free from any real oversight. “These companies baselessly claim that any regulation will hurt their bottom-line. As Free Press has shown repeatedly, treating broadband like a common-carrier service does nothing to dampen or dissuade private investment in this crucial infrastructure. And the question for any court interpreting the Communications Act must be what is in the public’s best interest, not just one industry sector’s financial interests.“Today’s decision will let the incoming Trump FCC abdicate its responsibility to protect internet users against unscrupulous business practices. It’s rich to think of Donald Trump and Elon Musk’s hand-picked FCC chairman characterizing light-touch broadband rules as heavy-handed regulation, while scheming to force carriage of viewpoints favorable to Trump on the nation’s broadcast airwaves and social media sites. “With today’s ruling, the 6th Circuit has for now denied the public the internet access service that it deserves — one that is affordable, reliable, safe, accessible, and free from unlawful discrimination. Despite this setback, Free Press will continue to fight — in the courts, in Congress, and everywhere — for an open, fair, and free communications network for all.”

The IRS complaint also requests that the IRS investigate a closely-related group, Midwest Growth Inc., that has engaged in similar activity. The complaints filed by CREW allege that Americans 4 Security is a political organization operating under the guise of a social welfare organization, in order to avoid disclosure obligations. Americans deserve transparency about the funding behind their elections.Americans 4 Security Inc.’s contributions to two super PACs accounted for as much as 90% of its total spending in 2020, its first year of existence. Since then, Americans 4 Security Inc. has continued to primarily dedicate its resources to political activity and in 2024, contributed more than $3 million to federal super PACs, the majority of which supported now-House Appropriations Committee Chairman Rep. Tom Cole (R-OK) in his primary election. Given the organization’s history of significant spending on political activities, it is likely that Americans 4 Security Inc.’s outsized political spending in 2024 will again account for a majority of its expenses.CREW’s FEC complaint alleges that Americans 4 Security Inc.’s past and current expenditures qualify it as a political committee under federal law. Such organizations must register with the FEC and make public disclosures of their finances, including disclosing the sources of their funding. Notwithstanding its extensive spending to influence federal elections, Americans 4 Security Inc. has never done so. Further, as a section 501(c)(4) nonprofit, Americans 4 Security Inc. may not be operated primarily to influence political campaigns and is required to file annual tax returns disclosing its political expenditures. Despite its extensive electioneering, which accounted for a majority of its spending in multiple years, Americans 4 Security Inc. has repeatedly told the IRS it did not engage in any political activity. A closely-related group, Midwest Growth Inc.has engaged in similar activity and in multiple years since its formation in 2016, the nonprofit has devoted the majority of its funds to making contributions to political organizations while repeatedly telling the IRS it did not engage in any political campaign activities.The public has a right to know the sources of funding that are influencing their elections. The FEC should investigate Americans 4 Security Inc. immediately to determine whether it should register as a political committee and disclose this information.
